Terms & Conditions

Hire Visual is a subdivision of Highly Visual Limited, a company registered in Kenya.
By hiring or reserving any equipment from Hire Visual, you agree to the following Terms & Conditions.

1. Definitions
  • “Company” means Highly Visual Limited trading as Hire Visual.

  • “Client” or “Hirer” means the person or entity hiring equipment or services.

  • “Equipment” means all items hired under the rental agreement, including accessories and cases.

  • “Hire Period” means the duration agreed between the Company and the Client.

 
2. Booking & Confirmation
  • Bookings can be made via our website, email, or phone.

  • A booking is only confirmed once the Client has:

    1. Signed the rental agreement,

    2. Provided all required documentation, and

    3. Paid the agreed rental fee and/or deposit.

  • The Company reserves the right to decline any booking request.

 
3. Documentation

Before release of equipment, all clients must provide:

  • Valid photo ID (passport, national ID, or driver’s licence)

  • Proof of insurance or acceptance of Hire Visual’s insurance option

  • Signed rental agreement

Additional verification (such as proof of address or company registration) may be required for new clients or high-value hires.

 
4. Payment, Rates & Deposits
  • Rates are charged per 24-hour period unless otherwise agreed.

  • Weekly hires are charged at four (4) times the daily rate.

  • Longer hires may qualify for discounts.

  • A refundable security deposit may be required depending on equipment value and insurance coverage.

  • All rates exclude VAT (if applicable), delivery, and insurance fees.

5. Insurance

Clients must ensure that hired equipment is fully insured against loss, theft, and damage during the rental period.
This can be done by either:

  1. Providing proof of independent insurance naming Highly Visual Ltd as loss payee; or

  2. Paying an additional 10% of the rental fee to be covered under Hire Visual’s insurance policy (subject to the insurer’s terms and exclusions).

The Client remains liable for any insurance excess, exclusions, or losses caused by negligence or misuse.

 
6. Collection & Delivery
  • Equipment can be collected from Karen, Nairobi by prior arrangement.

  • Delivery is available at additional cost, subject to location.

  • The Client is responsible for the equipment from the moment it leaves the Company’s premises until it is returned and checked.

 
7. Refunds & Cancellations
  • 75% refund if cancelled more than 72 hours before hire start date

  • 50% refund if cancelled within 48 hours

  • 25% refund if cancelled within 24 hours

  • No refund once hire has commenced
    All cancellations must be made in writing (email or message confirmation required). Refunds are processed within 7 working days.

 
8. Loss, Damage & Late Returns
  • The Client is responsible for all equipment during the hire period.

  • Lost, stolen, or damaged equipment must be paid for in full (less any applicable insurance cover).

  • Damage caused by negligence or misuse is not covered by insurance.

  • Late returns without prior notice will incur additional daily hire charges.

 
9. Drone Hire & KCAA Compliance
  • All Hire Visual drones are KCAA-registered and compliant with Kenya Civil Aviation Authority regulations.

  • Clients wishing to hire drones must provide:

    • A valid Remote Pilot Licence (RPL), and

    • KCAA Operational Authorisation.

  • No drone will be released without these documents.

  • Clients must operate drones in accordance with Kenyan airspace safety laws and KCAA guidelines.

 
10. Use of Equipment Outside Kenya
  • Equipment may only be used outside Kenya with prior written consent.

  • Cross-border hires require adequate insurance and compliance with import/export regulations.

  • Clients must inform Hire Visual of filming locations in advance for approval.

 
11. Liability
  • The Company will not be liable for any indirect, consequential, or loss of production resulting from equipment failure or delay.

  • Liability is limited to the replacement or rental cost of the equipment for the hire period.

  • Clients are responsible for ensuring they are competent in the use of hired equipment.

 
12. Ownership

All hired items remain the sole property of Highly Visual Limited at all times.

 
13. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Kenya, and any disputes shall be resolved in Kenyan courts.
